Lomax Lead Notifications

Terms of service

Lomax Lead Notifications is an internal service, not a product offered to the public. These terms describe what it is, who may use it, and the limits of what is promised.

Last updated: 27 October 2026

1. What the service is

Lomax Lead Notifications sends an email and a text message to Lomax Window & Door Co. staff when a visitor submits the quote-request form on the Lomax Window & Door Co. website.

The service belongs to Lomax Window & Door Co. (5748 S College Ave., Unit B, Fort Collins, CO 80525, (970) 225-3869) and is run on its behalf by an authorized technical service provider engaged by Lomax. Lomax is responsible for the inquiries and owns the information in them.

In these terms, “the operator” means Lomax Window & Door Co. together with the technical service provider acting on its behalf.

2. Who may use it

The service is for the internal use of Lomax Window & Door Co. There is no public sign-up, no user account, and no public interface. It is not offered to, and may not be used by, anyone else.

3. Acceptable use

The service may not be used to send unsolicited bulk email, marketing email, marketing text messages, or any message unrelated to responding to an inquiry submitted through the website.

It sends only to a staff email address and a staff telephone number configured by the operator. It does not send to any address or number supplied by a visitor, and it is not used for promotional or bulk messaging of any kind.

4. Messaging providers

Email notifications are delivered through Twilio SendGrid and text message notifications through Twilio. Use of those services is subject to the providers' own terms and acceptable-use policies, and the operator is responsible for using them within those policies.

Because every message is sent to a telephone number the operator controls, and never to a member of the public, there is no consumer subscription, no marketing campaign, and nothing for a recipient outside Lomax to opt out of. Standard carrier message and data rates may apply to the Lomax staff number that receives the notifications.

5. Privacy

The privacy policy forms part of these terms and describes what information is handled, including personal information submitted by website visitors.

6. Availability and no warranty

The service is provided as is, without warranty of any kind. No uptime or delivery guarantee is given. Message delivery depends on third-party providers and mobile carriers and can fail or be delayed for reasons outside the operator's control.

Because a notification can fail, inquiries are stored in a database independently of the notifications, so that an inquiry is not lost if a message is not delivered. That is a design property of the service, not a guarantee of any particular response time.

7. Limitation of liability

To the fullest extent permitted by law, the operator is not liable for indirect, incidental or consequential loss arising from use of the service, including loss of business arising from an undelivered or delayed notification.

8. Changes and termination

These terms may be updated; the date above will change when they are. The operator may suspend or discontinue the service at any time.

9. Governing law and contact

These terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules.

Any dispute arising from them shall be brought exclusively in the state courts located in Larimer County, Colorado, or in the United States District Court for the District of Colorado, and the parties consent to the jurisdiction and venue of those courts.
